Where Subscriber uses any of the following products, features or functionality, these Product Specific Terms are, as applicable, incorporated into and form a part of the Agreement between Algolia and Subscriber for the provision of the Algolia Services (“Agreement”). Capitalized terms used but not defined have the meanings given to them in the Agreement. All updates to these terms will be posted at https://www.algolia.com/policies/product-specific-terms and will become effective thirty (30) days after posting.
Algolia’s NeuralSearch language models continuously improve through a training process that learns from anonymized patterns across Algolia’s network of subscribers. To do so, if Subscriber is on a plan that includes access to NeuralSearch, Subscriber hereby grants Algolia and its Affiliates a worldwide, nonexclusive, revocable, transferable, sublicensable, royalty-free and limited license to use, store, copy, modify, transmit, display, reproduce, and create derivative works of Subscriber Data to train Algolia’s NeuralSearch models. This license does not give Algolia the right to train its NeuralSearch models using Subscriber Personal Data. Subscriber can opt-out of training Algolia’s NeuralSearch models at any time via the Algolia user interface dashboard. New Subscriber Data added after the date of opt-out will not be used to train Algolia’s NeuralSearch models.
Algolia offers a suite of Services that use generative artificial intelligence (the “Generative Experiences”). The Generative Experiences allows subscribers to create and provide input, in the form of contextualized prompts or queries, to the Generative Experiences (“Input”) to allow the Generative Experiences to generate content, text or images based on Input (“Output”). Input and Output are Subscriber Data and are subject to all provisions governing Subscriber Data in the Agreement.
When using the Generative Experiences, Subscriber will: (1) not confuse or mislead Users by misrepresenting Output as human generated or original content; (2) where required by applicable law, disclose to its Users that they are interacting with generative AI as part of the Generative Experiences; (3) not use the Generative Experiences for high risk activities, as defined by applicable law; and (4) where Subscriber uses any AI chat features of the Generative Experiences, implement and maintain all policies and procedures required for compliance with applicable laws or regulations, which may include obtaining consent from Users to the transcribing and hosting of live chat transcripts by Algolia.
THE OUTPUT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND. For the avoidance of doubt, Algolia does not warrant that the Output is fit for Subscriber’s particular purpose, non-infringing, marketable, accurate or reliable. Subscriber is solely responsible for evaluating the accuracy and appropriateness of the Output for Subscriber’s specific use case, including by utilizing human review as appropriate. Subscriber understands and acknowledges that (i) Subscriber may not be able to claim copyright ownership in any Output, (ii) Subscriber should not rely on factual assertions in the Output without independently confirming their accuracy, and (iii) due to the nature of machine learning, Output may not be unique, and the Generative Experiences may generate the same or similar output for other subscribers.
Algolia Agent Studio enables Subscribers to use, create and/or deploy AI agents for their own business purposes.
Due to the nature of Agent Studio, Subscriber may use generative artificial intelligence as part of Agent Studio and Subscriber agrees to comply with the terms governing Generative Experiences.
Algolia shall have no liability for any actions taken or decisions made by AI agents created by Subscriber, including but not limited to, any interactions with third-party services or platforms. Subscriber acknowledges and agrees that where it directs an AI agent to connect to a third-party website, service or platform, Subscriber has all necessary consents and permissions required for such connection. Subscriber is solely responsible for ensuring that all actions performed by such AI agents comply with all applicable laws, third-party terms of service and privacy policies and the Algolia Acceptable Use Policy.
Agent Studio Memory offers the ability for Subscribers to personalize the search experience of End Users based on their preferences or based on Algolia’s predictions of End User preferences. Where Subscriber enables Memory, Subscriber instructs Algolia to process its Subscriber Personal Data to develop End User Memories for personalization purposes and agrees that it has all consents necessary to permit such processing by Algolia. Subscriber shall only use End User Memories made accessible by Algolia for the purpose of the Services and permitted under applicable laws and regulations.
