1. Beginning and agreeing to the terms
These Terms of Service (“Terms”) are a legally binding agreement between you (“User,” “you”) and Waglees LLC (“Waglees,” “we,” “us,” “our”) that governs how you can access and use the Waglees website, mobile app, and any related services, features, content, or functionality (together, the “Service”).
You agree to these Terms, our Privacy Policy, and our Cookies Policy by accessing, registering for, or using the Service. These Policies are included in these Terms by reference.
You can’t use or access the Service if you don’t agree to these Terms.
You promise that you are legally able to sign this agreement and that you are at least the minimum age set by law to use the Service.
1.1 Age Requirements
The Service is only for people who are at least sixteen (16) years old. You agree and promise that you are at least sixteen (16) years old when you access or use the Service. Waglees does not knowingly collect personal information from kids under 16.
If Waglees finds out that personal information about a child under 16 was collected without proper permission, they will delete it as required by law.
2. Service Description
Waglees is a digital platform for dog owners that combines features of a virtual pet experience, task-based gaming, location-based services, and a social community.
The Service lets users make virtual versions of their real dogs and do daily tasks, challenges, and rewards related to dog care, training, and socializing with other dogs.
2.1 Age Requirements
The Service has a gamification system based on how virtual pets work (like “tamagotchi”). Users can earn virtual rewards called “Happiness Bones” for doing things like taking care of dogs and getting involved in their community.
There are two kinds of Happiness Bones:
- Basic Happiness Bones come from doing things like feeding, watering, walking, grooming, playing with, and training the dog.
- Hero Happiness Bones can be earned by doing things in the community, like talking to people, adding to maps, and going to events.
Happiness Bones are virtual markers in the Service. They don’t have any real-world monetary value, can’t be traded for goods or services, and don’t give you any ownership rights. Waglees can change, rebalance, cap, or reset the gamification mechanics at any time.
2.2 Features for Socializing and Community
The Service has social features that let users publish text, images, and videos, talk to other users, react to posts, leave comments, report content or users, and browse content using different filters, like proximity-based or discovery views.
All of the community features are only there for social and informational reasons. Waglees does not promise that user-generated content is correct, good, or reliable.
2.3 Map and Location-Based Features
To use location-based features of the Service, the User must give their explicit consent. This is done through the operating system’s (iOS or Android) built-in permission systems, which ask for permission to use location services, the camera, and access photos or media files.
When these location-based features are turned on, they may show the User’s location on the map. By default, other users of the Service may be able to see your location, but future controls and settings may let you manage or limit who can see your location.
The Service may let Users:
- begin and keep track of walks using location data in real time;
- add, confirm, or disagree with dog-related points of interest (POIs);
- report dangers or places that are important;
- filter and look through map content.
Location-based features only work when the User gives permission and turns them on. Users can change their minds at any time by going to the settings of their device or app. Waglees doesn’t promise that location data will always be correct, available, or up to date.
2.4 Events and activities in the community
The Service may let Users plan and take part in community events, like group walks, public or private events, and other get-togethers for dog owners.
Users or Waglees can make events that are system-organized activities, challenges, or competitions. The person who makes an event is also in charge of it and moderates it.
Waglees does not oversee, regulate, or take responsibility for events organized by users, nor does it ensure attendance, safety, or results of any offline activities.
2.5 AI Assistant
The Service may come with an AI-powered virtual assistant called “Charlie” that gives advice, suggestions, and information about dog care, behavior, nutrition, health, and how to use the Service.
Charlie’s AI mediation system has many layers that work together to make responses more accurate and better. Even though Charlie uses curated sources and verification methods, all of the answers it gives are only for informational and educational purposes.
Charlie does not give professional advice about animals, health, behavior, or the law, and you should still talk to a qualified professional. Users agree that they are still solely responsible for making decisions about their dog’s health, behavior, and care.
Waglees does not guarantee that AI-generated answers are complete, accurate, or appropriate, and it is not responsible for any actions taken based on this information.
2.6 Changes to the Service
Waglees can change, add to, limit, or stop any part of the Service at any time, with or without notice. This includes features, mechanics, or availability.
3. Eligibility and signing up for an account
You need to make a user account to use the Service. When you sign up, you agree to give accurate, complete, and up-to-date information and to keep your account information up to date.
Waglees only lets one account per user, unless they say otherwise. You are responsible for keeping your login information secret and for everything that happens under your account.
You are the only one responsible for:
- everything that happens through your account;
- any content you make, upload, or share;
- any time you talk to or do something with other users, online or off.
Waglees can suspend or end accounts that have false information, break these Terms, or put the Service or other users at risk.
3.1 Profiles for Users and Pets
You can make the following with the Service:
- a user profile, which includes a nickname, avatar, and account settings;
- one or more pet profiles that show real animals that you take care of.
Pet profiles are digital versions of real animals. The user gives all the information in a pet profile, and the account holder can change or delete it at any time.
You agree that you have the legal right to make and manage pet profiles linked to your account and that you are responsible for making sure the information is correct.
4. Features Based on Location
4.1 User Permissions and Consent
Some parts of the Service depend on being able to access location data and other device features. Users will be asked to give permissions through native iOS or Android mechanisms when they first use the Service and whenever the operating system needs them. This includes access to:
- GPS and other location services;
- camera;
- storage for photos or other media.
Location-based features only work when the User has given clear permission and turned on the necessary settings. Users can change or take away permissions at any time through the settings on their device or app. If you take back your consent, some parts of the Service may not work or be limited.
4.2 Visibility of Location
If location-based features are turned on, the Service may show the User’s location on the map.
By default, and until new features are added, other Users of the Service may be able to see where you are. Waglees may add more controls or visibility settings in the future, but they can’t promise that these options will always be available.
Users understand and agree that allowing location sharing raises privacy and safety issues, and they are responsible for how they use these features.
4.3 Tracking Walks and Using Maps
The Service lets Users start and keep track of walks using location data that is updated in real time or almost real time. While you are walking, the Service may keep track of your route, distance, time, and other activity-related information.
Users can also use the map to:
- adding dog-related points of interest (POIs), like parks, vet clinics, pet stores, shelters, or training centers;
- confirming, disputing, or reporting POIs that are already there;
- reporting dangers or other important information about the environment;
- filtering and looking into the content of maps.
All map-related content, such as points of interest (POIs) and hazard reports, is created by users or verified by the community and is only meant to be used for information. Waglees does not check, approve, or guarantee that this information is correct, complete, or up to date.
4.4 Group Activities and Events
The Service may let Users plan or take part in offline activities like group walks, public or private events, or community gatherings.
Individual Users or Waglees can make events, which can be system-organized activities, challenges, or competitions. The person who makes an event is in charge of organizing it and moderating it. They are also in charge of managing participation, communication, and behavior at the event.
Waglees:
- does not keep an eye on or control activities that happen offline;
- does not check the identity, qualifications, or behavior of participants;
- is not responsible for any injuries, damages, losses, or problems that happen as a result of taking part in events or group activities.
Users are free to choose whether or not to take part in offline activities, and they do so at their own risk.
4.5 Accuracy and Availability of Location Data
GPS signals, mobile networks, and device hardware are all examples of third-party technologies that location-based features rely on.
So:
- Location data might not be accurate, might take a long time to get to you, might not be complete, or might not be available at all.
- The content of the map may not show what is happening right now;
- It is possible that route tracking and distance measurements are not exact.
Waglees does not guarantee the accuracy, dependability, or availability of location-based features and is not responsible for any decisions or actions taken based on this information.
4.6 Technologies for Future Locations
Waglees may add more location-based technologies or integrations in the future. These could include hardware devices like GPS pet trackers.
Any of these features will have to follow extra rules, disclosures, or permissions that may be given when the features are made available.
4.7 No emergency or safety service
The Service is not a service for emergencies, safety, tracking, or rescue. You shouldn’t depend on location-based features to keep Users, pets, or property safe from loss, injury, theft, or harm.
Users are always responsible for keeping their pets safe, watching over them, and taking care of them, no matter what location-based features the Service offers.
5. Rules for User Content and the Community
5.1 Content Made by Users
Users can make, upload, publish, and share text, pictures, videos, comments, reactions, and other materials through the Service. This is called “User Content.”
Users still own their User Content. But when you send User Content through the Service, you give Waglees a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, publish, display, distribute, and make available that User Content only for the purposes of running, improving, promoting, and providing the Service.
This license stays in effect as long as the User Content is still available through the Service. It may also last for a reasonable amount of time after deletion to meet technical, legal, or backup needs.
5.2 Responsibility for User Content
You are solely responsible for the User Content you submit and for any consequences that arise from its publication or sharing.
You promise and guarantee that:
- you own the User Content or have the rights, licenses, and permissions to share it;
- Your User Content doesn’t break any laws, rules, or rights of third parties;
- Your User Content does not violate anyone else’s rights to privacy, publicity, or intellectual property.
Waglees does not support, check, or guarantee the accuracy, quality, or reliability of User Content, and it is not responsible for any User Content that Users make available.
5.3 How to Act in the Community and What Is Acceptable
Users agree to treat each other with respect and act responsibly in the community.
You agree not to use the Service for:
- post or share content that is illegal, harmful, abusive, harassing, hateful, false, obscene, or misleading;
- pretend to be someone else or misrepresent your relationship with them;
- share content that encourages violence, hate, or breaking the law;
- upload viruses, spam, or do things that are dishonest or misleading;
- gather or try to gather other users’ personal information without their permission;
- interrupt or interfere with the Service, its infrastructure, or its security.
Waglees has the right to set, change, and enforce community standards whenever it wants.
5.4 Reporting, Moderation, and Enforcement
The Service gives Users tools to report content or other Users who break these Terms or the law.
Waglees may, at its own discretion:
- look over the content that was reported;
- take away, limit, or turn off access to User Content;
- suspend or cancel user accounts;
- limit how visible or interactive they are.
Waglees doesn’t have to keep an eye on User Content all the time, but it can do so if the law requires it or to protect the Service and its Users.
5.5 Filters, Search, and Visibility
There are different ways to show User Content, such as proximity-based filters, recommendation systems, or curated views.
Waglees does not promise that any User Content will get a certain amount of visibility, reach, or engagement. System logic, moderation choices, user preferences, or community standards could all affect visibility.
5.6 Community Safety Disclaimer
Users take their own risks when they interact with each other, whether online or offline. Waglees doesn’t check users’ identities, qualifications, or intentions, and it isn’t responsible for any problems, disagreements, or harm that happen as a result of users interacting with each other.
When using the Service to interact with other people, users should be careful, use the reporting tools that are available, and make smart choices.
5.7 Notice of Copyright Infringement and DMCA
Waglees respects other people’s intellectual property rights and wants Users to do the same.
You can send a written notice under the Digital Millennium Copyright Act (DMCA) if you think that any content on the Service violates your copyright.
To do this, you need to provide the following information:
- identification of the work that is claimed to have been infringed;
- finding the infringing material and where it is on the Service;
- your phone number;
- a statement that you honestly believe the use is not allowed;
- a statement, under oath, that the information is correct;
- your signature, either in person or online.

Waglees may take down or block access to content that is said to be infringing, and they may also kick out people who keep doing it.
6. Rules for acceptable use and game mechanics
6.1 Gamification System
The Service has a structured gamification system that is meant to promote responsible dog care, regular participation, and positive involvement in the Waglees community.
The “Happiness Bones” system is made up of tasks, challenges, achievements, and virtual signs of progress that all work together.
The gamification system is an important part of the Service experience, but it only works in the virtual world.
6.2 Types of Happiness Bones
The Service makes a difference between two types of virtual rewards:
- Routine (Basic) Happiness Bones come from doing things that have to do with taking care of your dog, keeping them healthy, training them, and doing your daily chores.
- Hero Happiness Bones are earned by doing things that help the community, like participating in events, making maps, referring friends, and other community-oriented activities.
There may be different rules for each category about limits, expiration, availability, and how to use them.
6.3 Limits, Cycles, and Resets
Happiness Bones may be subject to:
- limits for each task;
- limits for each cycle, like every day, week, month, or longer;
- total caps that apply to a certain group;
- automatic resets that happen on set cycles.
Not finishing tasks, not doing anything, or reaching certain limits may slow down your progress, end your streaks, or make some virtual rewards expire. These effects are planned and expected parts of the gamification system.
6.4 Expiration and Redemption
Some Happiness Bones, like Hero Happiness Bones, may go bad if they aren’t used or redeemed within a certain amount of time.
Users may be able to trade in certain virtual rewards for non-monetary benefits, promotional access, discounts, premium trials, or other in-app perks, but this is only possible if they are available and meet other requirements.
Redemption options, values, and availability are not guaranteed and may change at any time.
6.5 Achievements, Streaks, and Statuses
Based on activity history and levels of engagement, the Service may show user statuses, achievement badges, streaks, leaderboards, or other signs of progress.
These signs:
- are only for information and motivation;
- don’t make any promises, guarantees, or vested right;
- may be changed, recalculated, reset, or taken away.
Waglees can change the logic, thresholds, or visibility of achievements whenever they want.
6.6 No Monetary Value or Ownership
Happiness Bones, accomplishments, levels, streaks, and bonuses:
- don’t have any cash or money value;
- do not constitute virtual currency, digital assets, securities, or property;
- cannot be sold, transferred, or exchanged outside the Service
Users agree that taking part in the gamification system does not give them any ownership rights.
6.7 Fair Use and Unacceptable Manipulation
Users agree not to:
- take advantage of or control the execution of tasks, referrals, events, or map validation;
- use scripts, automated systems, or fake data submissions;
- plan fake activities to get rewards or benefits.
Waglees can take away rewards, cancel progress, limit features, or suspend or end accounts if they find that someone is misusing or abusing them.
6.8 System Changes and Administration
Waglees manages, configures, and versions the gamification system. It can be changed, updated, or restructured at any time without notice.
Users agree that:
- The rules, point values, caps, and mechanics may change;
- Changes like these could affect progress;
- If you keep using the Service, you agree to the new rules.
For internal, informational, or support purposes, the technical and administrative details of the gamification system may be written down separately.
6.9 Safety Over Monetization
Waglees puts safety, health, and responsible pet care ahead of making money or making games.
Regardless of account type or subscription status, information about pet health, safety alerts, emergency guidance, and reminders for critical care may be made available.
7. Payments, Subscriptions, and Extra Features
7.1 Free and Paid Access
The Service may have both free and paid features, which are called “Premium Features.“
You might be able to get basic access to the Service for free. Paid subscription plans may include some advanced features, such as better tools, analytics, AI-powered features, or extra benefits.
Waglees can add, change, or remove Premium Features at any time.
7.2 Levels and Plans for Subscriptions
Waglees may have one or more subscription plans or tiers, which may have different features, coverage, availability, or prices.
There may be, but not limited to, the following subscription plans:
- AI-powered features that are better or bigger;
- advanced analytics, insights, or suggestions;
- extra community or social features;
- exclusive access to selected content, tools, or services.
When you buy or activate a subscription, you will be told what specific features are included.
7.3 Premium Features Powered by AI
Certain Premium Features may include advanced AI-powered functionality provided through the Service.
Users agree and acknowledge that:
- AI-generated content is provided for informational and educational purposes only;
- AI features do not replace professional veterinary, medical, behavioral, or legal advice;
- Waglees does not guarantee the accuracy, completeness, or suitability of AI-generated outputs;
- Users remain solely responsible for decisions made based on AI-generated information.
Access to AI-powered features may vary depending on subscription tier, availability, usage limits, or system capacity.
7.4 Trials, Promotions, and Invitations
Waglees may offer free trials, promotional access, discounts, or invitation-based benefits, including limited-time access to Premium Features.
Such promotions:
- may be subject to additional terms or eligibility requirements;
- may be modified or discontinued at any time;
- do not create an ongoing entitlement to Premium Features beyond the promotional period.
7.5 Billing and Payments
Subscription fees, billing cycles, and payment methods will be disclosed at the time of purchase.
Payments may be processed through third-party payment providers, app stores, or alternative payment methods, depending on the platform and jurisdiction.
Unless otherwise stated, subscriptions automatically renew at the end of each billing cycle until canceled by the User.
7.6 Changes, Cancellation, and Refunds
Users may cancel subscriptions in accordance with the procedures provided through the applicable platform or payment provider.
Waglees reserves the right to:
- change subscription pricing or features with prior notice where required by law;
- modify or discontinue subscription plans;
- offer refunds or credits at its discretion, unless otherwise required by applicable law.
Refunds and cancellations are subject to the policies of the relevant payment provider or app store.
7.7 No Guarantee of Availability or Results
Waglees does not guarantee:
- continuous availability of Premium Features;
- specific outcomes, insights, or improvements resulting from Premium Features;
- that Premium Features will meet all User expectations.
Premium access enhances the Service experience but does not alter the User’s responsibility for pet care, health, or decision-making.
7.8 Future Offerings
Waglees may introduce additional paid features, subscription tiers, or related products or services in the future.
Any such offerings may be subject to additional terms, pricing, or disclosures provided at the time of availability.
8. Privacy & Data Protection
8.1 Relationship to Privacy Policy
Waglees is committed to protecting User privacy and personal data.
The processing of personal data in connection with the Service is governed by Waglees’ Privacy Policy, which forms an integral part of these Terms and describes in detail:
- what personal data is collected;
- how and why it is processed;
- the legal bases for processing;
- data retention periods;
- User rights under applicable data protection laws.
By using the Service, Users acknowledge that they have reviewed and understood the Privacy Policy.
8.2 Cookies and Tracking Technologies
The Service uses cookies and similar tracking technologies in accordance with the Cookies Policy.
Users can manage cookie preferences through available consent mechanisms, browser settings, or device-level controls, as described in the Cookies Policy.
8.3 Location Data and Permissions
Certain features of the Service rely on location data, device permissions, and user-generated information.
Location data and other sensitive information are processed only:
- when the User grants explicit consent through native device permission mechanisms;
- in accordance with the Privacy Policy and applicable data protection laws.
Users may withdraw consent at any time, subject to limitations imposed by device settings or feature availability.
8.4 Data Protection Laws and User Rights
Waglees processes personal data in compliance with applicable data protection laws, including, where applicable:
- the General Data Protection Regulation (GDPR);
- the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA);
- other applicable U.S. state and international privacy laws.
Depending on their location, Users may have rights to access, correct, delete, restrict, or object to the processing of their personal data, as described in the Privacy Policy.
8.5 Data Processing Addendum
Where Waglees processes personal data on behalf of business customers or partners, such processing may be governed by a separate Data Processing Addendum (DPA).
The DPA defines the roles, responsibilities, and obligations of the parties with respect to data protection and security.
8.6 Security Measures
Waglees implements appropriate technical and organizational measures designed to protect personal data against unauthorized access, loss, alteration, or disclosure.
However, no system can be guaranteed to be completely secure, and Users acknowledge that they use the Service at their own risk.
8.7 Third-Party Services
The Service may integrate with or link to third-party services, tools, or platforms.
Waglees is not responsible for the privacy practices of third parties, and Users are encouraged to review the applicable privacy policies of such services before engaging with them.
8.8 Data Transfers
Because Waglees operates globally, personal data may be transferred to, stored, or processed in jurisdictions outside the User’s country of residence.
Where required by law, appropriate safeguards are implemented to protect personal data during international transfers, as described in the Privacy Policy.
9. Safety, Health & Liability Disclaimers
9.1 No Veterinary, Medical, or Professional Advice
The Service, including any content, recommendations, reminders, insights, or AI-generated outputs, is provided for informational and educational purposes only.
Nothing within the Service constitutes or should be relied upon as:
- veterinary advice;
- medical diagnosis or treatment;
- behavioral therapy;
- nutritional or dietary prescription;
- legal or professional advice of any kind.
Users are solely responsible for consulting qualified professionals, including licensed veterinarians, trainers, or other specialists, before making decisions regarding their dog’s health, behavior, diet, or well-being.
9.2 AI Assistant Disclaimer (Charlie)
The AI assistant (“Charlie”) provides automated, AI-generated responses based on available data, models, and contextual inputs.
Users acknowledge and agree that:
- AI-generated responses may be incomplete, inaccurate, outdated, or inappropriate for a specific dog or situation;
- AI systems cannot account for all individual factors, medical histories, or real-world conditions;
- responses generated by Charlie are not binding and must not be treated as authoritative instructions.
Waglees does not guarantee the accuracy, reliability, or suitability of AI-generated content and disclaims liability for actions taken or not taken based on such content.
9.3 User Responsibility for Pet Care
Users acknowledge that they are solely responsible for:
- the supervision, safety, and care of their pets;
- monitoring their pet’s health, behavior, and physical condition;
- ensuring compliance with applicable laws, regulations, and local requirements related to pet ownership.
The Service does not replace responsible pet ownership, professional care, or common sense.
9.4 Community Interactions and Offline Activities
The Service may facilitate interactions between Users, including communication, group walks, events, or meetups.
Waglees does not:
- verify the identity, qualifications, or intentions of Users;
- supervise or control offline interactions;
- guarantee the safety, conduct, or behavior of participants.
All offline interactions and activities are undertaken at the User’s own risk. Users are encouraged to exercise caution, judgment, and appropriate safety measures when engaging with others through the Service.
9.5 Events and Group Walks Disclaimer
Events and group activities may be created by Users or by Waglees.
Unless explicitly stated otherwise:
- Waglees does not organize, manage, or supervise User-created events;
- event creators act as independent organisers and moderators;
- Participation in events is voluntary.
Waglees disclaims liability for injuries, damages, losses, disputes, or incidents arising from participation in events, walks, or other offline activities.
9.6 Location and Safety Disclaimer
Location-based features may display approximate positions, routes, or points of interest.
Users acknowledge that:
- location data may be inaccurate or delayed;
- The map and POI information may be old, missing, or wrong.
- The Service may not show environmental conditions, or risks may not be reflected in the Service.
Users are still responsible for checking safety conditions and making the right choices when using location-based features.
9.7 No emergency or rescue service
The Service does not respond to emergencies, monitor them, rescue people, or track them.
Users should not depend on the Service for:
- stopping loss, injury, or damage;
- emergency care for pets;
- Monitoring safety in real time.
In an emergency, users must call qualified professionals or emergency services right away.
9.8 Limitations on Trust
Users agree to the following by using the Service:
- any reliance on information provided through the Service is at their own risk;
- Waglees is not responsible for any results that come from using the Service, AI-generated content, community interactions, or gamification features.
10. Intellectual Property
10.1 Who owns the service
Waglees owns or has a license to the Service, which includes its software, code, architecture, algorithms, databases, user interfaces, designs, graphics, logos, trademarks, text, audio, video, and other materials (collectively, the “Waglees Content“). Intellectual property laws and treaties protect the Waglees Content.
Users do not get any rights or licenses to the Waglees Content unless these Terms say so.
10.2 Permission to Use the Service
Waglees grants Users a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
Users are not allowed to do the following with this license:
- Copy, reproduce, change, share, sell, or rent any part of the Service;
- reverse engineer, decompile, or try to get source code;
- Without written permission, you can’t use the Service for business, competition, or automated purposes.
10.3 Trademarks
All brand names, service marks, logos, and other brand elements shown in the Service, including “Waglees,” belong to Waglees or their owners.
Users can’t use Waglees’ trademarks or branding without getting written permission first.
10.4 User Feedback and Content
The User still owns User Content, but they have a license to use it under Section 5.
Waglees can use any feedback, suggestions, ideas, or improvements that Users send in about the Service without having to pay or give credit.
10.5 AI Models and Results
Waglees or its licensors own the AI systems, models, orchestration logic, and underlying technology that the Service uses.
Users can only use AI-generated outputs from the Service for personal purposes within the Service itself. Users can’t say that they own the AI systems, models, or methods that were used to make these outputs.
Waglees keeps all rights that are not specifically given in these Terms.
11. Ending and Suspending
11.1 Termination by the User
Users can stop using the Service at any time and ask for their account to be deleted by following the steps outlined in the Service or the Privacy Policy.
If you delete your account, you may lose access to User Content, virtual rewards, achievements, and other related data, unless the law requires you to keep it.
11.2 Suspension or Termination by Waglees
Waglees can stop, limit, or end a User’s access to the Service, in whole or in part, at any time, for any reason, including when Waglees has good reason to think that the User:
- has broken these Terms or the law;
- has acted in a way that is abusive, harmful, dishonest, or dangerous;
- has abused the Service by using its gamification, community, map, or AI features;
- puts other Users, animals, or the Service itself in danger.
Such actions may be taken with or without prior notice, as long as the law allows it.
11.3 Effects of Termination
Upon suspension or termination:
- You may lose access to the Service and Premium Features right away;
- You may lose virtual rewards, progress, or benefits without getting anything in return;
- These Terms will end any licenses that were given.
Parts of these Terms that should still be in effect after termination, such as intellectual property, disclaimers, limitation of liability, and governing law, will stay in effect.
11.4 Keeping and Deleting Data
Termination or suspension does not mean that all User data must be deleted right away.
The Privacy Policy, the law, and legitimate business or legal obligations will determine whether personal data is kept or deleted.
11.5 No Liability for Termination
Waglees will not be responsible for any loss, damage, or trouble that comes from suspending or ending access to the Service, including losing data, content, or virtual rewards, to the fullest extent allowed by law.
12. Limitation of Liability
12.1 You use the Service at your own risk
The Service is given to you “as is” and “as available.“
Users agree and understand that they use the Service at their own risk to the fullest extent allowed by law. Waglees does not guarantee that the Service or any content made available through it will be reliable, available, accurate, or appropriate.
12.2 No Guarantees
To the fullest extent permitted by law, Waglees expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- implied warranties of being able to sell;
- suitable for a specific purpose;
- not breaking the law;
- the content or data’s accuracy, completeness, or trustworthiness.
Waglees does not promise that the Service will always be available, free of errors, safe, or free of problems.
12.3 Limitation of Liability
Waglees, its affiliates, directors, officers, employees, contractors, and licensors will not be responsible for any indirect, incidental, consequential, special, punitive, or exemplary damages to the fullest extent allowed by law. These damages include, but are not limited to:
- loss of business opportunities, revenue, or profits;
- losing data, content, or virtual rewards;
- injury to oneself, damage to property, or loss;
- damages that come from trusting content made by AI;
- damages that come from events, activities, or interactions in the community.
This is true no matter what legal theory is used to claim liability, even if Waglees has been told that such damages could happen.
12.4 Limit on Liability
If the law doesn’t allow Waglees to completely avoid liability, their total liability for all claims related to or arising out of the Service shall not exceed:
- the amount the User paid Waglees for the Service in the twelve (12) months before the event that led to the claim;
or - if no fees were paid, $100 USD, ine hundred U.S. dollars
whichever is bigger, unless the law says that a higher minimum is needed.
12.5 Exceptions
Nothing in these Terms shall limit or exclude liability where such limitation or exclusion is prohibited by law, including liability for:
- death or injury to a person caused by gross negligence or intentional wrongdoing;
- deceit or lying about something;
- consumer protection rights that must be respected and cannot be given up.
12.6 Limits on Jurisdiction
Some places don’t let you leave out or limit certain kinds of damages. In these situations, the above limits will apply to the fullest extent allowed by law.
13. Compensation
You agree to protect Waglees, its affiliates, directors, officers, employees, contractors, and licensors from any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) that come up because of or are related to:
- your access to or use of the Service;
- You broke these Terms or the law;
- your User Content, which includes any claims that this content violates the rights of others;
- your interactions with other Users, such as going to events, walking with a group, or doing things in person;
- your trust in content or suggestions made by AI through the Service.
Waglees has the right to take over the exclusive defense and control of any matter that is subject to indemnification, but it must pay for it. You agree to fully work with Waglees to use any defenses that are available.
14. Law and Jurisdiction
The laws of the State of Delaware, United States, will apply to these Terms and any disagreements, claims, or issues that come up because of or are related to the Service or these Terms, regardless of what Delaware’s conflict of laws rules say.
Users agree that any legal action or proceeding that comes up because of these Terms or the Service must only be brought in the state or federal courts in Delaware, unless the law says otherwise. Users also agree to the personal jurisdiction and venue of these courts.
This section does not limit consumers’ rights to file claims in their home country if those rights are required by consumer protection laws.
15. Changes to the Terms
Waglees can change, update, or replace these Terms at any time.
Users will be told about important changes to the Terms through the Service, by email, or by other reasonable means before those changes go into effect, if the law requires it.
If you keep using or accessing the Service after the updated Terms go into effect, you agree to the new Terms. If a User doesn’t agree with the new Terms, they must stop using the Service.
You can always find the most recent version of the Terms on the Service or Waglees’ website, and the date they went into effect will be clear.

17. Force Majeure
Waglees will not be responsible for any failure or delay in performance that is caused by things that are beyond its reasonable control. These things include, but are not limited to, acts of God, natural disasters, pandemics, war, terrorism, labor disputes, power or internet outages, failures of cloud service providers, government actions, or failures of third-party services.
18. License Agreement for End Users
You have a license to use the Service, not buy it.
Waglees gives you a limited, non-exclusive, non-transferable, and revocable license to download, install, access, and use the Service only for your own personal, non-commercial use on devices that you own or control, as long as you follow these Terms.
You can’t:
- copy, change, share, sell, sublicense, or rent any part of the Service;
- reverse engineer, decompile, or try to get the source code, unless the law says you can;
- use the Service in a way that is against the law or these Terms.
Waglees owns all rights, titles, and interests in the Service, including all intellectual property rights.
If you don’t follow these Terms, this license will end automatically.
