Anatel Mandates Vivo Maintain MVNO Contract with NLT Brazil's National Telecommunications Agency (Anatel) has issued a precautionary measure forcing Vivo (Telefônica Brasil) to continue providing services to the Mobile Virtual Network Operator (MVNO) Next Level Telecomunicações (NLT). The determination, issued on September 29th, orders Vivo to "refrain from unilateral termination of the instrument until the delivery of a decision on the merits." This intervention stems from a contractual dispute between the two companies, the specific details of which remain confidential within Anatel's process files. The dispute is not confined to the regulatory arena; it has also been judicialized. Anatel's injunction explicitly conditioned its measure to any decisions made by the court system. Public records show that Vivo and NLT Telecom have been engaged in a legal battle since the beginning of 2024. In granting the injunction, which was requested by NLT, Anatel cited the significant negotiation difficulties between the companies and the potential consequence of the "possible exclusion of a competitor in the market in the contracting of the sharing of use of virtual mobile network (#MVNO)." The agency clearly viewed the unilateral termination as a threat to competition. Should Vivo fail to comply with the ruling, the telecom giant faces a daily fine of R$ 100,000 (USD $18,721). NLT is a major player in the mobile virtual network operator market, primarily dedicated to the Internet of Things (IoT) segment. It reports approximately 1.1 million accesses, according to recent market data. The injunction's timing is noteworthy, coming amid intensified criticism from the MVNO sector directed at Anatel. These criticisms followed the agency's decision to exclude the virtual operator market from its General Plan of Competition Goals. MVNOs Lament Legal Uncertainty After Anatel's New Competition Plan Major mobile virtual network operators (MVNOs) in Brazil have voiced significant frustration and concern over legal uncertainty created by the National Telecommunications Agency (Anatel). The MVNOs are reacting to Anatel's recent approval of the "General Plan of Competition Goals" (PGMC), which conspicuously omits incentives for competitive agreements between MVNOs and the large network-owning telecoms. The critique came during a fiery debate at the Futurecom 2025 event in São Paulo, where CEOs from prominent MVNOs Arqia, Telecall, and iuh! (formerly Nuhdigital) delivered a stark diagnosis of the current market. Laerte Magalhães, CEO of iuh!, called Anatel's decision a "setback." He argued that the regulator's retreat on the matter leaves very few incentives for fair, competitive negotiations between MVNOs and established telecoms. "Although the number of MVNOs has grown in recent years, our customer representation is still very low, and this is a reflection of negotiations that are simply not competitive," Magalhães stated. The sentiment of uncertainty was echoed by Tomas Fuchs, CEO of Arqia and chairman of the Datora board. "The legal uncertainty is big, and we don't know what will happen," he lamented. Fuchs argued that the new PGMC sends a signal that the regulator is "satisfied with the competition in the mobile market," before posing a critical question: "But is the consumer satisfied? We are very frustrated." One of the central, most pressing open issues involves the wholesale reference offers (WRO) for MVNOs. These offers were previously mandated as part of the remedies established by CADE during the sale of Oi Mobile. According to the executives, these crucial WROs will no longer be available, and critically, the new PGMC provides no framework or incentive to replace them. Fuchs pointed out that even for MVNOs with already-signed contracts, Anatel's decision casts doubt on their future effects. Bruno Kelman Ajuz, CEO of Telecall, acknowledged that the absence of these mandatory offers will make it "more difficult" for new MVNO entrants. For companies with existing contracts, Ajuz believes a closer, more strategic relationship with the network suppliers will become increasingly necessary. The #MVNO executives were quick to stress that their segment's market share in Brazil remains significantly underdeveloped. Ajuz highlighted that the Brazilian market is small compared to the rest of Latin America, and the disparity with Europe is even more pronounced. Despite the current challenges, Fuchs argued that the large network providers are missing a massive opportunity by not fully embracing the MVNO segment as a valuable sales channel. TIP Brasil Acquires TÁ Telecom, Vows Deeper ISP Focus and MVNO Expansion TIP Brasil has announced the acquisition of 100% of the shares of tá telecom. The acquisition is set to bolster TIP Brasil’s mobile portfolio aimed at internet service providers (ISPs), while maintaining the existing accredited Mobile Virtual Network Operator (#MVNO) model and promising substantial operational synergies. According to Cristiano Alves, Commercial Director of TIP, the core operating strategy will remain unchanged: the MVNO model exclusively focused on internet providers. tá telecom will be preserved as an independent brand and operation. "TIP believes a lot in the MVNO market. We understand that the future of ISPs is MVNO and the future of MVNO is through ISPs," Alves stated, emphasizing the long-standing relationship and consolidated base TÁ has built with providers. He provided strong assurance that TIP will not engage with the final consumer directly. "The internet provider will always be in the middle, the TIP will never reach the end-customer. The business model will not change, ever," he reinforced. Rudinei Carlos Gerhart, CEO of TÁ Telecom, who will remain in his role, stressed that the move is more than a simple sale, positioning it as an integral union. TÁ was originally structured by 14 partners, including at least ten providers. Gerhart anticipates that the collaboration will ensure operational continuity while yielding significant efficiency gains. "The sum is not arithmetic, it is not one plus one equals two, it is one plus one equals five," Gerhart said, adding that the goal is to "improve the operation and deliver a product that makes much more sense at the end." TÁ currently partners with over 200 providers and has between 60,000 and 70,000 "human" activations on its platform. Carlos Eduardo Rattis, TIP's Head of MVNO, highlighted that the integration will immediately allow the expansion of offerings to TÁ's existing base. New products and services, including fixed telephony, IoT, AI, TV, streaming, surveillance, and telemedicine, are set to be introduced. Crucially, TÁ will gain access to additional mobile network coverage. TIP currently operates MVNOs with various carriers including Surf (TIM), Telecall (Vivo), Vero (TIM), and Unifique (TIM). Rattis noted a key immediate benefit: "It is a product that today TÁ does not have. It will now also be able to sell the Vivo network," broadening the range of options TÁ's partners can offer. The operational plan involves maintaining two distinct corporate structures while integrating operations for efficiency. Alves explained the synergy, stating, "If TIP is having a bottleneck, we will use the TÁ operation. Today, according to Anatel data, only 43 thousands of 5G base stations, in Brazil — compared to much higher penetration rates in those leading markets. While VIVO, TIM, and CLARO are making strides, especially in major cities like São Paulo, Rio de Janeiro, Brasília, and Goiânia, large portions of the country remain underserved. Let’s look at some key numbers: - In São Paulo, yet 5G base stations remains limited to just 87% of the 4G base stations. According to Artifex Consulting LLC estimations, the MNOs requires an increase between 62 to 102 thousands base stations to guarantee indoor and outdoor coverage. - In contrast, Porto Seguro, a popular tourist destination, shows the 5G base stations remain limited to just 33% of the 4G base stations. Porto Seguro will need between 938 and 1474 new 5G base stations to offers indoor and outdoor coverage. Following the 5G auction held three years ago, 5G sites represent only 50% of 4G sites. This is a slow rollout to reach 5G's potential and impact the Brazilian economy. These figures tell us something powerful: Brazil has both the demand and the density to support scalable 5G networks — but we’re not deploying at scale fast enough. 📣 🌎 ANATEL published Resolution No. 780/2025 on August 1st, 2025, introducing changes to the Resolution 715 regarding the certification process for telecom products in Brazil (Click here to access Resolution 715 updated by Res. 780). Key updates include: 👉 Mandatory certification for data centers that are part of telecom networks; 👉 Joint liability for marketplaces (e.g., Mercado Livre, Amazon, Shopee) that offer non-certified products; 👉 Expanded definition of violations, now including activities such as advertising, quoting and storing non-certified equipment; 👉 Stricter rules for refurbished or second-hand products, which may only be certified for specific public programs. [5G coverage in Brazil, cont'd] Related to my previous post (link in comment), I found more data from Brazil, showing location of base stations (from ANATEL according to source). So, again got a quick view on below map, example for operator TIM. The yellows are the markers of the base station, and the reds are the reported covered areas by 5G from operator. They overlap quite well, with some yellows not having reds because of data timing differences (as I understand, coverage data is from late 2024, while base station data is from May 2025). Note that yellow areas look "bigger", just because I set the markers big enough to be clearly visible to contrast with the red color. Quick technical tip: Latitude and Longitude in original dataset are expressed as a string, which you need to convert accordingly to the desired format for your own mapping (decimal or DMS). Format is: [degree][SNWE][minute][second] where: S=south (so, negative degree), N=north (positive degree), W=west (neg), E=east (pos). Happy mapping! 😊 Leonardo Zanoni Pedrini #5G #Brazil #Coverage
