Hail, Hail, the Gang's All!

Lil Mayor Luke does Pittsburgh a solid and drops out of the race, but now apparently every Johnny-come-lately (and Joanne-come-lately) wants to throw their hat into the ring. Retired PA State Auditor General Jack Wagner and City Council President Darlene Harris are already gathering petitions. PA State Sen. Jim Ferlo is planning to begin gathering signatures today. And, according to The Trib, City Councilman Ricky Burgess and State Rep. Jake Wheatley are feeling out the unions, but aren't commenting to the media. They of course join City Councilman Bill Peduto and City Controller Michael Lamb.

Who's on first? According to PoliticsPA:
Today’s developments benefit Peduto most directly; Wagner and Lamb share a political base in Pittsburgh’s south side/south hills.

Burgess to vote YES for anti fracking referendum

Last week Councilman Ricky Burgess abstained from voting on having a referendum to amend the city's Home Rule Charter to include a ban on fracking.

He just said in council chambers that he would vote yes on the final bill (even while questioning the motives of Council members who were for the referendum).

He said he was voting yes because he favors letting the people decide and in hopes that his bills for referendums would be able to go through.

So, that would be six yes votes -- making it veto proof from Lil Mayor Luke.

Yes!

"BRUUUUUUUUUUUUCE!"

That was the cry heard repeatedly last night at Pittsburgh City Councilman Bruce Kraus' victory party.

Kraus joined Darlene Harris and Patrick Dowd in beating back Lil Mayor Luke's BFFs to win their primary races. (We sure hope that Corey O'Connor is serious about being independent and we keep a progressive majority on Council.)

I have to say how much it still burns me that ACDC endorsed Jeff Koch this year for City Council District 3. Koch won 3 in a special election in 2006. He had two years to prove himself. But the voters of my district rejected him in 2006 for Bruce Kraus. Why did ACDC think that they knew better than the voters this year? Thank goodness that the citizens ignored both ACDC as well as the lies from the Koch camp and went with the candidate who has proven his worth. The citizens prevailed and Kraus won handily.

Congratulations to Bruce and congratulations to Harris and Dowd. And, while I would have rather seen Chris Zurawsky win, I also offer my congratulations to Corey O'Connor. Their race was notably free from shenanigans and negative campaigning.

(And, if you're waiting for me to congratulate Rev. Ricky, you've obviously never read this blog before.)

Pittsburgh City Council Races -- It's getting really ugly out there!

First, if you haven't already, you should read this article by Joe Smydo in the Pittsburgh Post-Gazette. In it, incumbents Darlene Harris and Bruce Kraus allege that there's been mayoral interference and "improper use of city resources" in this year's primary races. Harris notes that street paving and pothole filling has been delayed and that PWSA workers have been seen removing her campaign signs. Kraus brings up "Ravenstahl's decision to hold up a $100,000 study of problems in the South Side entertainment district" and that "the administration allowed city police Chief Nate Harper last week to address a meeting organized by one of the councilman's opponents, Jeff Koch, a city public works supervisor who's backed by the mayor." There's also the matter of a stop sign on Pius St. that was disallowed before the race, but suddenly appeared when Koch contacted his public works colleagues.

So what's the latest?

First, from the Lucille Prater-Holliday campaign:

11th Hour Trickery Clouds Race in District 9

With two days until the Election Day, and the campaign of Lucille Prater-Holliday gaining momentum, illegal campaign tactics are apparently being used to cloud the campaign.

A series of outgoing calls have apparently been made with the return number masked so that it appeared as if the calls were made from the Prater-Holliday campaign office.

Multiple calls are going out to the same individuals. Anyone who received a call that may have contained inaccurate or offensive information is asked to contact the campaign office at 412-259-3866.

A police report has been filed.

We are asking the campaigns of Phyllis Copeland-Mitchell and Ricky Burgess to repudiate any illegal or deceptive campaign tactics that are being used to harm the campaign of Ms. Prater-Holliday, and to let the campaign know if they have any information about the calls.
Then there's this -- Darlene Harris' campaign headquarters were vandalized:

Hmmm, what does this remind me of? The accompanying press release also says that items have been thrown at Harris' personal vehicle while she was driving at night.

Lastly, the previously mentioned P-G article notes that Lil Mayor Luke's buddies Koch, Tony Ceoffe (running against Patrick Dowd), Vince Pallus (running against Harris), and Ricky Burgess (running against the world) have all made allegations of improper campaign financing. Now, these charges have been looked into repeatedly by Chris Potter at the Pittsburgh City Paper (here, here, and here) and found wanting. You can also read Bill Peduto's detailed explanation of the city's campaign finance reform law here*. It's worth noting that the biggest critic of how others follow this law -- the Rev. Ricky Burgess -- wants to scrap it altogether.

Not surprisingly, Jeff Koch has come out with a new flyer that mostly slams Bruce Kraus on the false allegations of failing to follow the campaign finance law:

We already addressed the raise increase and redecoration "issues" here. And, Kraus is not "fighting bars." He's trying to get businesses and residents to exist in harmony for which, as noted above, Koch's buddy, the Mayor, is holding up money to do.

Peduto's response to Burgess’ legislation to rescind the City’s campaign finance reform laws

I receivied the following statement from Pittsburgh City Councilman Bill Peduto today regarding Councilman Ricky Burgess’ legislation to rescind the City’s campaign finance reform laws:

“In 2009, City Council passed campaign finance reform legislation - a reform that was long overdue for the City of Pittsburgh. It is disappointing to learn that Councilman Burgess would bow to the pressure of big money interests and reverse the reforms that Pittsburgh fought so hard to enact. Councilman Burgess’ attacks against the law are hollow and wrong. He is simply giving in to special interests and working to hide who is funding his campaign. The voters deserve to know who is pay-rolling this effort before they vote – and state law requires he tell them.

The City’s laws on acceptance and disclosure of contributions follow the federal rules and this was clearly discussed during Council’s debate in 2009. These efforts to rewrite history and create turmoil for political gain right before an election are being done at the expense of good government and transparency.

I look forward to the debate on this issue. It is further regrettable that Councilman Burgess would try to waive the rules of Council to vote on this bill tomorrow even further taking away the public’s ability to voice their position on this matter. I am dismayed that Council Members Lavelle, Dowd and Smith would support the waiver of rules to bring this up for a vote before the public has an opportunity to comment.

The people of Pittsburgh should be vigilant. Those who favor a "pay to play" government have given their orders and Councilman Burgess is working to deliver a gift for them – at the public’s expense.”

Pittsburgh Pension Problem: Almost There

Those of you listening to 80's pop on the City Channel for a couple of hours today probably were wondering what the holdup was. We understood that Pittsburgh City Council was to hold a Legislative Session at 1:30 today to overturn Mayor Ravenstal's "cooperative" veto to attempt to stave off state control of the city's pension. The meeting actually started around 2:00 and almost immediately was recessed until after 3:00 PM.

Council did overturn the Mayor's veto today (8 to 1; Rev. Burgess being the only dissenting vote), thus putting the new Council/Controller plan into place which dedicates the asset of future parking taxes to the city pension fund to bring that up to 50% funded.

The hold up -- the reason why Council must meet again tomorrow -- is that upon further reflection by everyone (PERC, ACT 47, ICA) it was decided that the City must dedicate $735,680,000 over 31 years instead of $414.7 million (the difference between a 5% and 8% discount rate).

New legislation is being drawn up to amend the Pittsburgh Code, Title Two - Fiscal, Article XI (I believe).

The Mayor will need to "cooperatively" veto this new legislation quickly so that Council may then override that veto. Council did note that the Mayor and his Administration have been very forthcoming in providing whatever Council has needed these last 24 hours or so. And in an email exchange between Council President Harris and Yarone Zober, Zober indicated that the Mayor will quickly veto this latest round so that Council may overturn the veto in time to meet the Midnight December 31st deadline.

Council will hold a Legislation Session tomorrow at 1:00PM (followed right after with a Standing Committee Meeting) and another 11:00PM Legislative Session -- yes, 11:00 PM on New Year's Eve -- followed by another Standing Committee Meeting.

Council Votes Down Mayor's Parking-Pension Plan In Preliminary Vote

In a preliminary vote today, Pittsburgh City Council voted down Mayor Luke Ravenstahl's 50-year giveaway parking privatization plan for the city's pension problem.

Bill 956:
Resolution authorizing the City of Pittsburgh to enter into concession arrangements with LAZ Parking and J. P. Morgan IFF Acquisitions LLC, operating as Pittsburgh Parking Partners, LLC with respect to on street metered parking and the garages and lots owned by the City and the Public Parking Authority of Pittsburgh (the "Authority") pursuant to the Pittsburgh Metered Parking System Concession and Services Agreement and the Pittsburgh Public Parking Facilities System Concession and Lease Agreement, and to authorize certain actions and ancillary agreements contemplated by the Metered System Concession Agreement and the Facilities Concession Agreement including the conveyance of Mellon Square garage and five (5) surface parking lots to the Authority as required by the Facilities Concession Agreement and the conveyance of parking meters and other items of equipment to the Concessionaire as required by the Metered System Concession Agreement. Pittsburgh City Council Election: The Fix Is In!

Just got off the phone with a political insider who had a sad sad story to tell.

It's a confusing tale, to be sure, but the bottom line is that back room deals were struck, backs were stabbed, and the fix seems to be in for the next Pittsburgh City Council President.

Not a pretty picture.

As there are 9 members of the City Council, a majority of 5 votes is needed to elect a president. It seems that 4 vote blocks are easy to get. It's that last, fifth vote that's all important.

Here's Rich Lord's setup from the end of December:
Pittsburgh City Council will pick a new leader Monday, and the biennial jockeying is in full swing.

On its surface a contest between Councilmen Ricky Burgess and William Peduto, it is also an opportunity for council to declare either a more collaborative approach to the mayor's office or a more independent stance. The last two years have seen the city's nine lawmakers swing wildly between those poles.

With a week left before two new members are sworn in and a president is picked, the post could still easily go to some other member.
Which is true. While it looks as though a deal's been struck, things could swing around. Perhaps if the details saw the light of day.

This is what I know so far:

A deal was struck between Ricky Burgess and Patrick Dowd on the one hand and Theresa Smith and Darlene Harris on the other to form a voting block. But what of the fifth vote?

Enter Representative Jake Wheatley. In a deal orchestrated by Mayor Ravenstahl and Representative Wheatley, Theresa Smith would get the City Council Presidency, Patrick Dowd would step down as Finance Chair and in exchange for his vote (the all-important fifth) incoming member R. Daniel Lavelle would be named Finance Committee Chair - on his very first day on City Council. Has that ever happened in Pittsburgh history?

Smith would be elected president with 8 months experience on Council. Has that ever happened in Pittsburgh history?

I was told that the deal was struck in mid-December at this meeting described by Rich Lord:
A similar tango occurred Dec. 17, when Mr. Burgess, Ms. Smith, Ms. Harris, Patrick Dowd and departing members Jim Motznik and Tonya Payne shuffled in and out of the mayor's office, talking about the since-killed tuition tax and the presidency.

Participants in those meetings said that if Mr. Peduto wins, he has pledged to give the high-profile post of finance chair to Mr. Kraus. Mr. Burgess is said to have promised that job to Mr. Dowd.

The choice of one or the other -- or neither of the above -- may be made by incoming member R. Daniel Lavelle. Members agreed that he's a likely swing vote, being wooed by both sides.
It was at this time that Wheatley and Ravenstahl struck the deal for the fifth vote. Read between the lines here:
When Tonya Payne wanted help during her four just-ended years on Pittsburgh City Council, she turned to her friend Luke Ravenstahl.

"The biggest thing that I had in my arsenal was: Luke Ravenstahl became the mayor," she said in an interview.

Now, as she embarks on a bid for a state House seat, she's doubtful that she can pull that arrow from the quiver again. This time, the mayor needs support in Harrisburg and in Council Chamber that can only come from her foes, Rep. Jake Wheatley, D-Hill District, and incoming Councilman R. Daniel Lavelle.
And a few paragraphs later:
Now Mr. Lavelle is believed to be a pivotal player in Monday's vote for the council presidency, courted by mayor-friendly and mayor-skeptical factions. Mr. Wheatley could be key to Mr. Ravenstahl's hopes of getting state help next year with the city's fiscal problems. And Ms. Payne has a seat on the powerful Urban Redevelopment Authority board, but needs a job.

"Tonya has always been a great supporter of mine, and I'm thankful for her leadership on council and her friendship," said Mr. Ravenstahl. "But we haven't had a discussion, despite some of the reports that are out there, about a job, or [campaign] support. ... I'm sure we will."
So Lavelle votes with Burgess and Dowd and gets finance chair, Luke gets a far more friendly City Council and more friends in Harrisburg.

And Patrick Dowd? He gets the satisfaction (as I was told) of beating Bill Peduto and Doug Shields.

And that's all I heard.

Patrick Dowd confirms he now backs Smith for Council President. Says they need someone who can work together with others and reach across divides. Says Smith has shown that capacity and will serve them well, moving forward.

UPDATE: From Chris Potter:
I'm going to suggest -- just for a second -- that we put aside the questions of who supports the mayor and who doesn't. Let's just analyze whether council will be led by people who know what the hell they are doing.

Like I said last week, I think Kail Smith's handling of the tuition tax could betoken a promising future. If she were being chosen as a compromise candidate -- if Ravenstahl hadn't just pulled his prevailing wage stunt -- there'd be reason to see a silver lining in her presidency. In such circumstances, she'd likely have a steady hand at her side -- Peduto serving as finance chair, for example. She'd have the benefit of experience, but without being laden with all the baggage.

But so far, at least, that ain't what's happening. Instead, the two city legislators with the most experience seem likely to end up with the least amount of power.

That is a surefire recipe for a weak, ineffectual council -- however well intentioned Kail-Smith or anyone else might be. Like I said last week, if council's choice isn't Peduto, "what other choice is there if council wants to be taken seriously?" I'm still not sure. But the choice definitely isn't a president and finance chair with less than a year's experience between them. That makes council a joke -- which of course would suit the mayor's agenda perfectly. It suggests council doesn't even take itself seriously -- so why should anyone else?

Again, though, things can change between now and council's meeting.
Anything can happen.

Potter, Again

Chris Potter has more:
A few more thoughts about the New Year's Eve Massacre ... and an attempt to clarify some of the more overheated rhetoric. Including my own.

I see that -- just as I predicted yesterday morning -- city councilor Patrick Dowd is trying to say that council got what it deserves when Luke Ravenstahl vetoed a bill too late in the year for council to override. Bob Mayo quotes Dowd sayingthat the mayor's 11th-hour veto is "poetic justice" for how council treated him.

Dowd also repeated his charge that council acted in a "fascist" manner. Bending the rules "is what fascists do," Dowd says.

Potter isn't a big fan of such juvenile name calling, by the way. He then sums things up a bit:
There's a broader picture here, one that council needs to think about on Monday when it chooses a president.
And completes the picture:
Make no mistake about it: Council got played. Ravenstahl won, and he did so by following the rules of the game. But that isn't the question. The question is, what's council's next move? Does it go with Ricky Burgess, who is offering a more conciliatory approach to the mayor? Or does it go with Bill Peduto, who would continue a more independent path for the legislative branch?

If I felt like Ravenstahl were the victim here -- if I felt like he hadn't had any chance to influence this legislation -- I'd be all in favor of Burgess' approach. But Ravenstahl had every chance to lead, and chose not to. He ceded that role to council, and then -- when he didn't get the results he wanted -- decided to thwart the legislation at the last possible moment. To me, that isn't someone who deserves the benefit of the doubt going forward.
We'll see what happens this week.

Potter Gets It Right. Again.

He writes. You read.

He begins:
We should have known.

We should have realized that it wasn't going to be this easy to pass a prevailing wage bill.

We should have known Luke Ravenstahl would pull something like this.
Then, after describing what happened (which the OPJ already did here) Potter continues:
If there is any justice in this city -- and maybe there isn't, at least if you're a service worker -- here's what will happen next. City Council will realize how badly it has been used. They will see this for what it is: a craven end-run around them, an insult not just to the city's legislature, but to the entire idea of a legislative process.

And on Monday, they will choose Bill Peduto as their next council president.
His reasoning:
Really, what other choice is there if council wants to be taken seriously? Ricky Burgess, Peduto's only real rival, launched his council presidency on the premise that council and the mayor's office should negotiate in good faith. But Ravenstahl's machinations have made it clear that the adminstration can't be trusted to do that. Burgess and Dowd, the only people to oppose a veto override, are teaming up on Burgess' presidential bid. Supporting Burgess' candidacy now amounts to approving of Ravenstahl's underhanded tactics.
So we'll see what happens this week.

McCain Camp Responds to Letter from Burgess about "B" Hoax

From The Busman's Holiday, here's McCain campaign spokesman Jeff Sadosky:
"The liberal blog post that the councilman cites has no basis in fact, the McCain campaign had no role in this incident. We hope the young woman involved in the incident gets the help that she needs, it's disappointing that Pittsburgh law enforcement time and resources were wasted by her false allegations."

Councilman Rev. Burgess Writes Letters

Here's a great one:

Dear Senator McCain and Governor Palin:

On Thursday, October 23, 2008, there was a report of a robbery, an assault and a mutilation filed by a volunteer for your campaign. According to the Pittsburgh Post-Gazette:
“She said a man armed with a knife demanded her money. She gave it to him, then began walking to her car, which had McCain stickers on it. She told police that although the robber had moved away from her, he became agitated when he saw her car, punched her in the back of the head, pushed her to the ground and carved a B into her face.”
John Verrilli, the news director for KDKA in Pittsburgh, told Talking Points Memo’s Election Central that your Pennsylvania campaign communications director gave one of his reporters a detailed version of the attack that included a claim that the alleged attacker said, "You're with the McCain campaign? I'm going to teach you a lesson." Mr. Verrilli also told TPM that the McCain spokesperson had claimed that the "B" stood for Barack.

The Post-Gazette went on further to say:
“Ms. Todd told police during at least five hours of questioning last night that her attacker said to her, "You are going to be a Barack supporter." She told police the man then sat on her chest, pinning both her hands down with his knees and used what she believed was a dull knife with a roughly 5-inch blade to carve the B.”
Your volunteer told the police that she was robbed, attacked, sexually assaulted, fondled and mutilated by an African-American man. However, we all now know that this tragic story was totally fraudulent. I am deeply troubled by the facts of this story. According to the Pittsburgh Post-Gazette:
“Mr. Garcia took the widely published picture of Ms. Todd with her injuries. He said he took several photographs with a digital camera to document what had happened. He said he only gave copies of the photos to police and Ms. Todd's employer, the College Republicans. One photo appeared on The Drudge Report on Thursday, setting off a storm of media attention.”
This much was true: A McCain-Palin official was pushing a version of the story that was far more explosive than the available or confirmed facts permitted at the time.

All too often in the halls of justice around the world, people are accused of crimes they did not commit. That one of your campaign spokespersons would spread such an incendiary story before any confirmation of the facts is both irresponsible and runs counter to our nation’s Constitutional guarantee that no one be denied life, liberty or property without due process. Moreover, that a representative of the McCain-Palin campaign would be so careless and in the process of doing so, cast aspersions on African-Americans, is unfair.

On behalf of the City of Pittsburgh and its’ African-American community, I respectfully request an apology from your campaign to the city for the conduct of your staff and volunteers. Both of you wasted little time in sending your wishes and prayers to Ms. Todd when the news reports were initially circulated, and so I trust that neither of you will waste anymore time leaving this issue unresolved. I would also ask that you send my personal prayers and well wishes to Ms. Todd and her family. I am certain these are trying times for them.

Final vote on the Lamar 4's legal bill today?

The final vote should be taken today "on the $10,706 bill from attorney Hugh McGough, hired by council President Doug Shields and members Ricky Burgess, Bruce Kraus and William Peduto to contest the now-revoked permit given to Lamar Advertising for a Downtown sign."

Since I missed all the fireworks last week, I'm very grateful that Char did an excellent job of covering it at The Burgh Report -- almost like you're there. [shudder]

(Did I mention that I couldn't be more pleased with the job that my own City Councilman, Bruce Kraus, is doing thus far? Guess I just did.)

New faces for Pittsburgh City Council: Kraus, Dowd, Burgess


After all the grief back in March over the Peduto mayoral pullout, this morning looks a lot brighter for progressives than anyone had a right to expect.

Machine hacks (There is no machine!) Len Bodack and Jeff Koch were ousted by progressives Patrick Dowd and Bruce Kraus. As other blogs have noted, it was the Pedutoistas who really got behind both these candidates after they no longer had Bill to support. Additionally the much embattled Twanda Carlisle lost heavily to Rev. Ricky Burgess -- instantly lowering the embarrassment quotient on Council. (Now what about Motznik?!)

While County Chief Executive Dan Onorato won easily as expected, his challenger Rick Swartz made a really decent showing with 13.45% of the vote. Especially when you consider that latecomer Swartz ran his campaign on $5,000 vs. over a million collected for Onorato.

I spoke to Swartz Campaign Manager Joy Sabl last night and according to her figures, Rick received about 3 votes for every dollar spent and nearly half the flyers distributed resulted in a vote -- a really good grassroots effort. Rick also received loads of good coverage last night (much owing to PCNC waiting for Onorato and Ravenstahl to show up resulting in their relying on Rick's after party for visuals). Republican curmudgeon Bill Green was quite complimentary towards Rick's grassroots efforts. Likely because he recently ran himself and has discovered exactly how much "fun" it is to got out collecting petition signatures in the coldest month of the year. Most importantly, Onorato's victory speech contained not only a gracious nod to Swartz, but the recognition that voters really do care about public transit. That was a real victory not just for Swartz, but for the residents of Allegheny County.

We also saw a progressive win in the City Controller's race with Michael Lamb getting over 42% of the vote.

And Luke Ravenstahl? Yep, he won resoundingly. But for those of you who have been made to feel crazy by the "Give the kid a chance" contingent, it should be noted that you no longer need to feel like a lone voice in the wilderness. A full 14% of the voters chose not to "I Like Luke." In addition to the 4% who chose to write in someone, another 9% chose to leave their ballot blank for Mayor (38,665 voted citywide for Controller, but only 35,705 voted citywide for Mayor). Moreover, write-in Republican candidate Mark DeSantis received over three times the number of votes needed to get on the ballot in November so it looks like Luke will have to face a debate after all (hehehehe).

All in all, a nice night for those of us who believe that ACDC is the problem.

UPDATE: I want to make sure to note that while I mentioned Bram's assertion that the Peduto folks helped the Dowd and Kraus campaigns, from what I saw, both those camps had tight, really well run efforts and candidates who were on fire. Kudos to their campaigns!

On top of that, as Smitty has commented, Koch really disintegrated in the last two weeks with all his crazy shit. Also, both campaigns paid loads of attention to the Burghosphere which doesn't hurt.

Don't Reward Bad Behavior

A big part of what makes Pittsburgh "America's Most Leavable City" is the arrogance, hubris, and feelings of entitlement of its leaders. In a One Party Town where the local Democratic Committee makes endorsements in primary votes (Hey, kids, did you know that Dem parties in other towns don't necessarily do this and let the voters have a real voice?), far too many of our elected officials seem to believe that they do not need to play by the rules and that they do not need to be accountable to their constituency.

So you have a Mayor who plasters his face and name on every flat surface in town, crashes private parties in his quest for further celebrity, and only tells the truth when the MSM catches up to his lies.

You have County Chief Executive Dan Onorato who believes that elections only serve to "distract" the public.

You have City Councilman Len BoDUCK Bodack who refuses all debates and tells his supporters that his challenger is "trying to take the food out of my kids' mouths."

You have City Councilwoman Twanda Carlisle who spends tens of thousands of dollars on a worthless report written by her mother's live-in friend and is under suspicion of funneling tens of thousands more dollars into her own pockets via payouts and kickbacks.

And, now you have City Councilman Jeff Koch whose campaign created T-shirts that were the exact same color as Public Works Dept. shirts that ended up on the backs of Public Works employees during work hours and whose own Campaign Treasurer was one of the workers wearing the shirt. (Not to mention that Koch has a history of not listening to the wants and needs of his district to the point of "telling an 80-year-old woman to 'sit down and shut up.'" at a community meeting.)

Don't reward their bad behavior and arrogance!

Let them know that they serve us -- not the other way around.

Let them know on May 15th.

These are your public officials -- don't encourage them -- don't give them any more of a stage for their silly antics:
