Gun show owner alleges rights violation

A gun show owner says the Austin Police Department violated his constitutional rights. Police are now setting the record straight.

The controversy centers around a yellow flyer passed out at the Texas Gun Show in North Austin last weekend. It reads:

 "Selling of Firearms"

 At the direction of the Austin Police Department and the Bureau of Alcohol, Tobacco and Firearms, anyone selling a firearm at this show location will be asked to comply with the following:
 
 1. Any person selling a personal firearm must go through a licensed FFL dealer in the show to transfer the  firearm to the new owner.

 2. Selling of firearms in the parking lot will not be permitted. 

 Thank you for your cooperation!

APD Detective T.J. Vineyard told reporters in a news conference Tuesday, the recommendations were the result of a year long police investigation of the gun shows.

"Every time we were there we observed transactions that were either questionable or illegal so our effort was to find ways to address that,” he said.

Vineyard said the goal of the operation was to stop illegal gun trafficking to Mexico.

"Some people would go to vendors to purchase a firearm, and when they were asked to fill out paperwork to do a background check they would bypass that vendor and go to another vendor that wouldn't require a background check,” Vineyard said.

HEB rents out the building where the gun shows are held. APD called a meeting with HEB representatives to figure out a plan to stop the problem. APD and members of the ATF recommended show owner Darwin Boedeker stop allowing private citizens to sell guns without the assistance of a licensed dealer. Thus, forcing every buyer to have a background check.

"Most of the people who are trying to achieve legitimate sales of firearms want that protection, They want to know the gun they're buying isn't stolen or the person they sold a gun to isn't a felon or on parole for murder,” Vineyard said.

Boedeker says the request is a violation of our constitutional right to freely sell guns.

"What they want to do is shut the gun shows down. This just doesn't affect me. This affects you, this affects the person down the road, every law abiding citizen,” he said.

Boedeker went along with the recommendations for last weekend's show, but still APD made an arrest. He says HEB has since told him he can no longer hold shows here. Boedeker is convinced police wanted HEB to make that call.

"At least they knew where to go to arrest them. If there wasn't a gun show, they'd be down in a back alley. Felons are always going to be able to get a gun. That's why they're felons. They don't follow the law,” Boedeker said.

"We didn't mandate anything, we didn't direct anyone to do anything. We made suggestions to them and how to handle that with their tenants or sub-leasers is a civil matter among them," Vineyard said.

Police say during the past year they have arrested eight people on illegal weapons charges. Texas Gun Shows has been using the North Austin Event Center since November. Before that the Saxet Gun Show was there. Boedeker says he knows of only one arrest since he's used the property. He says he's trying to find a new location for his show.

i just got an email from the The Boedeker Family. "we have found a temporary building. It is an old Target building on the east bound side of IH 35 at the Wm. Cannon exit. We will be there Feb. 20 & 21" ....... shows on gentleman. BE THERE

APD does not have a right to impose their OPINION! They are only allowed to force people to follow the law and on that note why can they ignore the laws that they do not like and pretend their opinions are laws? This is a blatant violation of our rights to buy and sell our personal property without restriction!

What people are not getting is the way the law reads. If a FFL Dealer wishes to sell his personal firearm that is not part of his business inventory he can do so without doing paperwork. This is one of the great things about Texas Gun law. You do not need paperwork to sell a personal weapon. People do not have to be a FFL dealer to be a vendor at a gunshow! ANYONE CAN BE A VENDOR! You idiots keep worrying about who is buying a gun! Why dont you worry about how many your government has!

People there were no laws being broken. An individual selling a firearm is in no way obligated to do background checks or enlist the services of a firearms dealer! This was WAY out of line by APD they do not have the rights to do this.

This shouldn't surprise anyone, years ago the gun shows were held in the coliseum. The city leaders used the police to run it away by standing at the door taking down the serial numbers of firearms being brought into the show. This resulted in firearms owners refusing to participate in this illegal recording of serial numbers and the gun shows moved to the Crockett Center to be on private property. I'm quite sure that if someone was to dig long enough and deep enough they would link this to the anti-gun folks here, not the APD officers who have to carry out their orders. Too bad the chief didn't stand up for what is right and refuse to have his officers hand out flyers that insinuated there were laws being broken when there were not.

this guy is making a big deal out of nothing - APD merely suggested things he could do to help prevent illegal sales. They are in turn being made a scapegoat, because HEB told him to follow the suggestion. APD didn't say 'if you don't follow these suggestions we will shut you down'. HEB made the call, so if he should be complaining about anyone, he should be complaining about HEB. But then again its not as if the felons and illegals who try and buy a gun there illegally can't just go down the street and buy it off some guy on the corner - that neighborhood is notorious for doing that kind of thing. But as the lease holder, HEB has every right to shut the place down.

Thank you for reporting on this contentious concern and giving it the visibility it deserves. True investigative reporting would reveal more depth about this. The reporter talks about 'the problem' without defining 'the problem' The reporter does not question the police about exactly what law is making the transactions illegal or questionable. The reporter does not ask the police if/how gun show sales have been correlated with movement of guns to Mexico. We do not know how HEB was involved, though their role in leasing the property must be significant to the story. The reporter does not discover or convey who 'passed out' the flyers at the show. KVUE, you can do in-depth investigative reporting as part of your service to the public. Your viewers deserve it.

APD as a RULE IGNORES the legal immigration Status of people that they deal with on a daily basis! This is in DIRECT violation of Federal law because all Law enforcement agents are obligated to enforce ALL laws! They CHOOSE not to enforce that law but decide to enforce something that is not even a law! WOW!

Weird. I thought the role of the APD is supposed to be enforcing the LAW. There is NO LAW prohibiting private firearm sales and NO LEGAL REQUIREMENT for an individual seller in Texas to conduct a background check on the purchaser. The legal stipulation for individual sellers is simply to ensure that the purchaser is at least 18 years of age. In this news story, Detective Vineyard claims sellers at the gun show were engaging in "illegal transactions", then he follows up with clarification that background checks were not being conducted. (Again, there is NO LEGAL REQUIREMENT for an individual firearm seller to conduct a background check; so just what made any alleged "illegal transactions" illegal?) And WHY, then, is APD involved in enforcement of "questionable transactions" -- or for that matter a "civil matter" between the tenant (HEB) and the sub-tenant (Texas Gun Shows) of a private property?? This is WRONG on so many levels!

What a total whitewash!!! That's total BS that HEB asked for help. APD and ATF intimidated HEB into railroading the show promoter!!! We should all stand behind Darwin. I know I will be attending his show wherever he is able to set it up.

Thanks to the Austin Police Dept. for their efforts to "Keep Austin Weird"! Unfortunately, this latest attempt at crushing the citizens Constitutional Rights got just a little bit of embarrassing National Press! Given the recent sea-change in political awareness by Texans (and all Americans) lately, one would think that the APD would be more interested in toeing the line, constitutionally-speaking. Protect & Serve, Servants of the People, and all that stuff. Judging by this situation, however, it is clear that Texans don't run Austin Texas! Washington does! They pull the strings, and APD jumps up for the doggie snack like the lapdogs they have now proven themselves to be. APD, you folks are BETTER than THIS!! Grow a pair, and stand up to what you KNOW is WRONG!!!

What utter balderdash! Mr. Boedeker was blindsided with this 2 days before the show. Moreover, to claim that he "consented" to this is utterly ludicrous. He sat across the table from an armed agent of the ATF and and armed officer of the APD. I have no doubt that the "request" or "suggestion" was akin to a robber's "request" or "suggestion" that a victim turn over his wallet to said robber. The claim of "consent" is a cover for plausible deniability used by bureaucrats to cloud the issues. These minions of the state had the capability, and no doubt the predilection shared by all bullies, to shut down the show and to cause Mr. Boedeker to lose his investment by nitpicking and misusing vague laws put on the books by shortsighted political hacks. Consent my foot! Finally, when confronted by "statistics" spouted from the moving lips of a government employee, be wary..be very wary.

UTTER BS! ANYONE can sell their Private firearm to anyone they wish to as long as that person is above the age of 18! There is no statute requiring a private citizen to do a background check!
