With Just 40 Votes, Republicans Block Debate Over Defense Authorization Bill

DADTclotureVoteMoments ago, in a 56-43 vote, Senate Democrats failed to invoke cloture on the 2011 National Defense Authorization Act, falling three votes shy of the 60 need to break a Republican filibuster. As is customary, Senate Majority Leader Harry Reid (D-NV) voted against the measure as a procedural tactic, allowing him to revive the bill at a later date. The result represents a major setback for advocates of repealing the military’s Don’t Ask, Don’t Tell policy and supporters of the DREAM Act.

Chances of invoking cloture began to fade early this afternoon, as moderate Republican Senators who support DADT repeal, used procedural explanations to substantiate their vote against starting debate on the measure. Along with concerns about voting to repeal the DADT policy before the Pentagon completed its year-long review and the suggestion that the DREAM Act was unrelated to national defense, the Republicans also complained that Majority Leader Harry Reid (D-NV) was limiting debate to just three amendments — DADT, DREAM, and secret holds. Reid, however, had made assurances that he would consider Republican amendments after the recess. Ignoring Reid’s concession, Republican moderates like Sen. Susan Collins (R-ME) took to the floor to equate repealing the ban against open service in the military to restricting the right of Republicans to offer alternative amendments:

SEN. SUSAN COLLINS (R-ME): “I support the provisions in this bill. I debated for them; I was the sole Republican on the Committee that voted for the Lieberman-Levin language on don’t ask, don’t tell. I think it’s the right thing to do, I think it’s only fair. I think we should welcome the service of these individuals who are willing and capable of serving their country. But I cannot vote to proceed to this bill under a situation that is going to shut down debate and preclude Republican amendments. That too is not fair.”

SEN. OLYMPIA SNOWE (R-ME): “First and foremost, the Senate should have the ability to debate more than the three amendments the Majority Leader is allowing…We should all have the opportunity to review that [DADT] report which is to be completed on December 1, as we reevaluate this policy and the implementation of any new changes”

SEN. SCOTT BROWN (R-MA): “The majority party, I feel, is using our men and women in uniform as a tactic to pass politically expedient legislation entirely unrelated to the defense authorization. It is in my view not appropriate.”

SEN. GEROGE VOINOVICH (R-OH): “The DREAM Act deals with immigration and shouldn’t be on this bill. ‘Don’t Ask, Don’t Tell’ is a controversial issue that needs to be debated on the Senate floor but I believe it would be logical to wait for the Department of Defense to issue its report on ‘Don’t Ask, Don’t Tell.’”

Democrats, who also today announced that they would likely adjourn a week early, say they plan to take up the act after the midterm elections. “We’re going to come back into session in November or December. I spoke to Sen. Reid today. He’s very clear and strong that he’s going to bring this bill to the floor in November or December,” Sen. Joseph Lieberman (I-CT) told the Washington Blade’s Chris Johnson. Lieberman also predicted that “opponents of the repeal of ‘Don’t Ask, Don’t Tell’ have enough votes to take that repeal out of this legislation,” something Collins confirmed in her floor speech today, saying that she would vote “against the amendment to strike don’t ask, don’t tell provisions from this bill.”

At a press conference earlier today, Durbin said that this is the first time since 1952 that the Congress failed to pass a defense authorization measure. “What would be unprecedented is if Republicans block the Senate from passing the defense authorization bill for the first time since 1952,” Durbin said.

Update It is important to note that senators representing a relatively small minority of the American population sustained a filibuster of a bill despite the fact that it contained very popular provisions. According to polling, 70 percent of Americans support the DREAM Act and 75 percent of Americans support fully repealing DADT. The 42 senators who filibustered the bill, on the other hand, represent only 36 percent of the American population. Thanks to senate procedure, a small minority can easily obstruct the will of the vast majority of the public.
Update Sens. Mark Pryor and Blanche Lincoln were the two Democrats who joined the Republican filibuster.

    This is is shrewd move by Dems. Now they can go out on the campaign trail blasting Repukes for filibustering a Defence bill. It also appeases the left who have been complaining there has not been a vote on DADT.

    Smart move all around. Repukes had nothing to gain and now have more things they need to defend for the election.

    serving in the armed forces was one of two possiblities for the children of undocumented immigrants to gain citizenship .

    These people have lived the vast majority of their life in the US and many if not most have never been to Mexico .

    Thanks to senate procedure, a small minority can easily obstruct the will of the vast majority of the public.

    The teabaggers want to repeal the Seventeenth Amendment and return selection of the US Senators to the states. With Senate rules like this, I wonder if it’s worth even having a US Senate at all. (I know, I know, we’re constitutionally stuck with the US Senate.)

    With the Republicans so dead set against any and all regulation, you’d think they would be happy to repeal one more piece of legislation.

    Los Angeles County Dist. Atty. Steve Cooley filed charges against eight current and former Bell officials Tuesday, alleging that they misappropriated $5.5 million in public funds. Robert Rizzo, Bell’s former city manager, has been charged with 53 counts of misappropriation of public funds and conflict of interest.

    The charges come after a dramatic morning in which authorities swept through Bell and other cities, arresting former and current Bell officials.

    Among those arrested were Rizzo; Angela Spaccia, former assistant city manager; Mayor Oscar Hernandez; councilmembers George Mirabal, Teresa Jacobo and Luis Artiga; and former councilmembers George Cole and Victor Bello.

    “This is corruption on steroids,” Cooley said.

    [Updated at 11:28 a.m.: Cooley said officials used the city's tax dollars "as their own piggy bank that they then looted at will."]

    2. The DOD is studying HOW, not whether, to implement the elimination of DADT. The Senate could vote with the completion of the study as a contingency for implementation of the change.

    Repugs have used procedural moves to require sixty votes on EVERY SINGLE ISSUE THAT COMES BEFORE THE SENATE — this was no exception.
    Now we are hearing from McCain and the repugs crying that they never get a seat at the table – they are not consulted.
    More obstructionism, followed by squealing, whining and pouting by the childish GOP.

    Democrats have – to our great dismay here in the country – extended compromise and negotiation time and time again only to be slapped away. When repugs were in the majority, there was no effort at negotiation or compromise – it was 8 years of my way or no way – they forced Democrats to hold meetings in cloak rooms and they even turned out the lights on Democratic meetings — but now that they are the minority and are given a chance to participate, they cross their arms and stomp their feet – NO! They cry. They will use every maneuver in the book to thwart any progress Democrats want to make.

    Now that debate on the bill has been voted down, the Democrats should threaten to shut down the Pentagon. And then do it.

    President Obama would have to bring the troops home because of lack of funds.

    He could also shut down all the military facilities in red states, too. How about completely demolishing them so there would be hundreds of thousands of Teabaggers permanently out of a job and dependent of socialist safety nets till kingdom comes or The Rapture?

    This is what the Republicans say they will do to all public services if they get the majority. Let’s give them a head start on what they want. See how voters like the idea before the election?

    Not a bad idea really.

    If chaos and more unemployment is what Republicans want, give it to them. They could say they won? That’s all they really care about. Certainly not equal rights for all.

    I was with a large extnded Mexican family for their independence day and explained to them what the Dream Act Was and that it would probabably be voted on this week .

    Most of those present fell into the catagory of ,having grown up here since very early childhood and several had lost other close family members over the last year .

    They were all very excited about it , as was I .

    If it were any thing else other than basic rights I probably wouldn’t even care .

    But it is about basic right for me and a quandary , which I’m sure you can appreciate. I can see little choice in my approach to screaming foul from the rooftops at the top of my lungs .This began with Bush and to my great dismay looks as though it will continue long into the future despite the promises that were made on the campaign trail.

    The fact that we are held hostage to this system is undeniable but as how to proceed in the face of such an assault on our laws is very complicated isn’t it .

    That doesn’t make me insincere or egotistical and bad manners are still bad manners .

Obama was elected and the Dems had a big majority, they could have ended the filibuster by simply changing the Senate rules in January 2009 by a simple majority vote. Did they bother to get rid of the filibuster so that they could easily pass some progressive legislation? Well, not exactly… actually, no. Obama and the Senate Dems much preferred to keep the filibuster in place so that they could conveniently blame the Republicans for a lack of progressive legislation being passed… See how the two corporate-imperialist-royalist Parties work together to keep corporatism, imperialism and royalism (tyranny) in place?

    Obama campaigned as a progressive, but once he took office, he changed into a corporatist… Was this the “change” that he promised us?

    What House ??? The house of Representatives is Majority Rules…they don’t have a Filibuster.

    The cloture rule originally required a supermajority of two-thirds of all senators “present and voting” to be considered filibuster-proof.

    the Senate tried eleven times between 1927 and 1962 to invoke cloture but failed each time. Filibuster was particularly heavily used by Democratic Senators from Southern states to block civil rights legislation.

    In 1975, the Democratic Senate majority, having achieved a net gain of four seats in the 1974 Senate elections to a strength of 61 (with an additional Independent caucusing with them for a total of 62), reduced the necessary supermajority to three-fifths (60 out of 100).

    So the RULES CAN BE CHANGED.

    Actually, if NO Democrats voted against cloture then the bill could not be revived for another vote as-is. It’s a wierd rule that should’ve been done away with years ago.

    Looking forward to seeing the Republicans remain the minority party come this Nov 3rd!
