Coburn Has ‘No Idea’ Whether He Would Have Voted To Confirm Thurgood Marshall

One of the main lines of attack that Republicans on the Senate Judiciary Committee have deployed against Elena Kagan’s nomination to the Supreme Court is her clerkship under under Thurgood Marshall, the first African-American justice. They have had no qualms about blasting the civil rights legend, with Sen. Jeff Sessions (R-AL) attacking Kagan’s association “with well-known activist judges who have used their power to redefine the meaning of our Constitution.” On Monday alone, Republicans mentioned Marshall 35 times during the hearing. By comparison, President Obama’s name was uttered only 14 times.

But today, Sen. Tom Coburn (R-OK) went further than merely criticizing Marshall, telling ABC’s Top Line that he has “no idea” whether he would have voted to confirm Marshall, even while knowing his “entire record as a justice”:

KARL: How would you have voted, knowing all that you know — I mean, now you know his entire record as a justice — would you have voted no on a Thurgood Marshall nomination?

COBURN: I have no idea. I don’t know his writings. I think that’s an important part of her history, but not as important the two things that I just mentioned

Coburn joins fellow Judiciary Committee member Sen. Orrin Hatch (R-UT), who said yesterday that it was “hard to say” whether he would have supported Marshall. As Salon’s Steve Kornacki noted, “That’s a rather stunning statement when you consider the dynamics of Marshall’s 1967 confirmation.” Only 11 senators voted against Marshall, and their opposition “had everything to do with race — and, more specifically, with lingering white Southern resentment of the court’s 1954 school desegregation ruling (in which Marshall, as the NAACP’s chief counsel, had played a leading role).” All 11 were White and Southern, and most had signed the “Southern Manifesto,” a pro-segregation document drafted by the late Sen. Strom Thurmond.

Moreover, Republicans can’t seem to provide any evidence to support their claim that Marshall was an “activist” judge. Talking Points Memo asked Coburn, Hatch, and Sessions which of Marshall’s opinions best exemplified his activism — “none of them could name a single case.” As the National Urban League’s Stephanie Jones wrote in today’s Washington Post, “Unlike many of his detractors, past and present, Marshall showed the utmost reverence for the Constitution” by defending equal rights for all Americans.

Commenting on the absurdity of Republicans’ attacks on Marshall, the Washington Post’s Dana Milbank wrote, “With Kagan’s confirmation hearings expected to last most of the week, Republicans may still have time to make cases against Nelson Mandela, Mother Teresa and Gandhi.”

Marshall was thoughtful in his choice of an epitaph for his tombstone, which reads something like “civil rights attorney,” instead of “Supreme Court Justice.” For all the good you did for others as an attorney, may you rest in peace, Justice Marshall.

    True, however in a greater arena one would be hard pressed to tell the differences between moderates on both sides simply by their voting records and alledged beliefs.
    To most ideologies the Republicans and the Democrates are away and aways closer then most opposition groups.

    In my honest opinion I think America would be better off with two new parties, one to the left and one to the right.

James Earl Ray who previously didn’t have two nickels to rub together arrested in London more than two months after the event as he arrived in London on a flight from Lisbon and carrying a Canadian passport. Right. Such an easy thing for a penniless wanted con to pull off. Memphis to Lisbon. No sweat. On the run for nearly three months in Europe. Right. Easy.

    King was a genuine “radical” in the sense that he was adamantly opposed to corporatism and the grotesque economic injustices of a capitalist society. (”Capitalsim,” of course, is not the same thing as a “free market system;” it is a legal system in which the laws favor the holders of wealth and capital.)

    One not read a great deal of King’s works to recognize these facts; but of course, one does have to at least read. This is why infantile hypocrites and slobbering imbeciles like Bleck, shortpinkyayas, or Martha V.D. think they can co-opt King to their vicious, manifestly fact- and logic-free purposes: being too monumentally stupid to entertain even the abstract possibility of learning anything about anything, they simply assume that their monumental stupidity is the same as genuine knowledge and expertise.     Forty year-old James Earl Ray, wanted in the United States in connection with the April 4, 1968 assassination of the Reverend Doctor Martin Luther King, Jr., was apprehended by Scotland Yard this morning at London’s Heathrow Airport. He had arrived in London on a flight from Lisbon to Brussels. He was carrying a Canadian passport in the name of Ramon George Sneyd. The name is that of a Toronto police constable and was apparently used without his knowledge.

    Ray was originally indicted for the murder of Dr. King in Memphis, Tennessee on April 23 under the name of Galt and was later re-indicted under his true name. On May 7, formal murder charges were filed against Ray in Memphis.

    When arrested, Ray was wearing a light raincoat, a sports jacket and gray trousers. His hair had been cropped short and he was wearing glasses, but otherwise had not attempted to disguise his features.

    Scotland Yard officers said they had found a fully loaded pistol in his hip pocket. According to officers at the scene, he offered no resistance and said nothing.

    Ray has been detained in Britain on charges of carrying a concealed weapon and using a fraudulent document–the passport. He was being held at London’s Cannon Row police station under maximum security conditions. British officials have said he will be arraigned Monday morning.

    As a measure of the importance US officials attach to the capture, Fred M. Vinson Jr., Assistant Attorney General in charge of the Criminal Division, is expected to leave Washington this afternoon and fly to London. It is expected that extradition proceedings will be initiated on Monday, and that the proceedings will take at least a week, perhaps more, to finalize.

    First off, it’s not really clear if MLK Jr was a Republican, it’s merely assumed he was. There are reports he was registered, but I can’t really find anyone saying this definitively. I’ll concede it’s possible. His father OTOH was the known registered Republican. And as others have pointed out, most Southern Blacks back then were registered Republican (but Democrat today) like the Democrats back then were actually Republicans in Democrat disguise (known as Dixiecrats).

    Second, if he was a proud Republican, then why did he vote Democrat? From the Washington Post article linked above:

    The younger King voted for Kennedy, and for Democrat Lyndon B. Johnson four years later. In that election, King publicly denounced the Republican candidate, Barry Goldwater.

    In fact, MLK Jr’s arrest is what triggered the Blacks to start registering as Democrats. Again, from the article:

    In 1960, King was arrested for trespassing during a sit-in and held in Georgia’s Reidsville prison. Fearing for his son’s life, Martin Luther King Sr. appealed to presidential candidate John F. Kennedy to secure his release.

    When King was freed, his father vowed to deliver 10 million votes to the Democrat, even though Kennedy was only a reluctant supporter of civil rights. That began four decades of black people voting for liberals.

    Third, Lee Harvey Oswald was never a registered Democrat, nor Republican. He was an American Communist. That’s well known, even on Yahoo!Answers:

    Timothy McVeigh was a registered Republican, though.
