1. Eligibility: The IGN Win Your Wishlist Sweepstakes (the "Sweepstakes") is open to legal residents of the U.S. (excluding Arizona, Rhode Island, and Puerto Rico) and Canada (excluding Quebec) age 13 or older, who are registered users on the IGN website and have Internet access as of the beginning of the Sweepstakes period.
Employees of IGN, its respective parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the IGN Win Your Wishlist Sweepstakes. Participation in the IGN Win Your Wishlist Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules & Regulations ("Official Rules"). VOID WHERE PROHIBITED.
2. To Enter: You may enter the Sweepstakes in one of two ways:
(a) To enter online (Registered Users), select the Sweepstakes link from the Sweepstakes main page (http://sweepstakes.ign.com) located on the IGN web site or go directly to http://users.ign.com. To be eligible for online entry, users must have at least 5 games in their ranked wishlist and 5 games in their game collection, and must have updated at least one of their user pages within 90 days of the weekly Friday drawing in order to be eligible to win between January 3, 2003, on or around 00:00 AM, Pacific Time, and December 25, 2003, on or around 23:59 PM, Pacific Time.
(b) To enter by e-mail without obligation, please send an e-mail to community@ign.com with The IGN Win Your Wishlist Sweepstakes in the subject line. In the body of your e-mail message, write your name, mailing address, phone number, and e-mail address, 5 videogames desired. All e-mail entries received during the Sweepstakes period are eligible, and eligibility begins with the very next drawing that takes place after receipt of your e-mail entry.
No mechanically reproduced mail-in entries are allowed and any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods.
Only one entry per person, household and/or e-mail address is permitted, regardless of method of entry. Entrants submitting multiple entries or violating any of these Official Rules may be disqualified.
3. Prize Drawing: All Sweepstakes entries meeting the requirements of these Official Rules will be entered into the prize drawing, to be held each Friday between January 3, 2003 and December 25 2003, at the IGN offices, 3240 Bayshore Blvd., Brisbane, CA 94005. Impartial persons whose decisions are final and binding will conduct the drawing. Impartial persons whose decisions are final and binding will conduct the drawing. All Winners will be selected at random from among all eligible entries received. Winners will be notified by e-mail.
4. Prizes and Odds: The prizes to be awarded from the Sweepstakes are as follows:
(a) Fifty-two (52) Grand Prizes: Each Grand Prize Winner will receive five (5) of the videogames selected on the users ranked wishlist, an estimated retail value of approximately $250.00 (U.S.)
Odds of winning a prize depend on the total number of eligible entries received. Winners are solely responsible for any and all federal, state, provincial and local taxes that apply to prizes. No cash or other substitution of prizes is permitted, except at the sole option of Sponsor, IGN, for a prize of equal or greater value. Prizes won by minors will be awarded to the parents or legal guardians, who must sign all required affidavits and releases. The Sponsors will not replace any lost or stolen prizes.
Total value of all prizes to be awarded: $13,000.00 (U.S.).
5. Notification of Winners: Winners will be notified by e-mail within one business day of each daily prize drawing, and may be required to sign and return an affidavit of eligibility and publicity/liability release within seven (7) days of notification. Winners can also visit http://users.ign.com every Friday to check to see if they've won, and claim their prize by clicking on their username. If a selected Winner cannot be contacted, is ineligible, fails to claim a prize and/or where applicable an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, prize may be forfeited and an alternate Winner will be selected from remaining valid, eligible entries timely submitted. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail account specified in the entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No automatically generated entries will be accepted. To win, Canadian residents will be required to correctly answer an arithmetical skill-testing question and to release IGN Entertainment and its agencies and representatives from liability with respect to the contest and prizes.
6. Privacy Policy: Any personal information supplied by you to IGN will be subject to IGN's privacy policy posted at http://corp.ign.com/privacy.html.
7. General Rules: By entering or claiming your prize, you agree to be bound by these Official Rules. The IGN Win Your Wishlist Sweepstakes is offered by IGN Entertainment, Inc., 3240 Bayshore Blvd., Brisbane, CA 94005, which is not responsible for late, lost, delayed, damaged, incomplete, illegible, or misdirected entries, responses, or other correspondence, whether by e-mail or postal mail or otherwise, or for theft or destruction or unauthorized access or alterations of entry materials, phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties. By participating and winning a prize, Winner releases IGN, its affiliates, subsidiaries, directors, officers, employees, sponsors, and agents, including advertising and promotion agencies, from any and all liability with respect to the IGN Win Your Wishlist Sweepstakes or the acceptance, possession or use of any prize, including without limitation (i) any condition caused by events beyond the IGN's control that may cause the IGN Win Your Wishlist Sweepstakes to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Promotion IGN Win Your Wishlist Sweepstakes; and (iii) any printing or typographical errors in any materials associated with the IGN Win Your Wishlist Sweepstakes. IGN's decisions in all respects relative to the IGN Win Your Wishlist Sweepstakes are final. IGN reserves the right, in their sole discretion, to cancel, modify or suspend the IGN Win Your Wishlist Sweepstakes in whole or in part, for any reason, but in particular in the event of fraud, technical or other difficulties or if the integrity of the IGN Win Your Wishlist Sweepstakes is compromised, without liability to the entrant. IGN reserves the right to disqualify any winner, as determined by IGN in its sole discretion. The winner is responsible for paying any income taxes on the value of the prize received. Void where prohibited or restricted by law. All federal, state, provincial and local regulations apply.
8. Additional Conditions: Except where prohibited, by accepting any prize, Winner consents to the use of his/her name, photo and/or likeness, biographical information, winning entry and statements attributed to winner (if true) for advertising and promotional purposes without additional compensation. All entries become property of IGN and none will be acknowledged or returned. Allow 6-8 weeks for delivery of prizes.
9. Winner's List, Official Rules: For a list of prize winners or a copy of these Official Rules, send an email message to community@ign.com with "Winner's list" as the email subject and IGN Win Your Wishlist Sweepstakes specified in the body of the e-mail.
